General terms of business of Clip Music

§1
General terms
Any work or orders Clip Music carries out
for the customer are solely based on these General Terms of
Business. Any agreement between company and customer is made in
writing.
§2 Conditions of use
To
buy any product it is required to enter the customer’s data
(name, address, E-mail address and password). The password serves
to identify the person authorized with the transaction and must
not be made accessible to a third party. Clip Music does not
accept any liability for abuse of passwords and resulting
consequences or damage.
The customer obliges himself/agrees to
give full information about his person according to the entry
window in the web site.
§3 Conclusion of
a deal
A deal will be concluded after the personal
data (e-mail address and password) have been entered in Clip Music
Shop and the financial transaction has been initiated by pressing
the payment button. The customer will then receive a confirmation
of his order to his e-mail address.

Delivery
Unless otherwise arranged the delivery will
be from the warehouse to the address given by the customer.
Statements about the deadline are non-binding unless the date of
delivery has been exceptionally and definitely accepted.

Return and exchange
1) Products may only be returned
if, in cases of warranty, Clip Music has expressly asked for it or
if Clip Music has mistakenly sent a different product than the one
ordered or if Clip Music has exceptionally accepted a return or
exchange in writing.
2) There is no return or exchange unless
a different arrangement has been made in written form.
§6
Acquisition of rights/copyright
The music items
/pieces of music offered are protected by law or other
regulations. The legal regulations are effective.
§7
Prices
The prices quoted on the internet site ‘Clip
Music Shop’ at the date of order are valid. With customers
the include the valid rate of VAT plus a flat rate for
shipping.
§8 Payment (Germany)
1)
All deliveries are solely made by advance payment.
2)
Payment by advance remittance. In this case the customer ticks the
appropriate sections and sends his order and transfers the sum to
the account of Clip Music. The transfer form must contain the
customer’s name so that the payment for the order can be
assigned to the order. With advance payments the shipping rate is
€ 3,90.
3) Payment by COD is made to the postman on
delivery. In this case the rate of shipping is €7,90 (€3,90
+ €4,00 COD fees) + €2,00 postal fees, depending on
rates at time of delivery.
§9 Payment and
delivery (abroad)
1) Delivery abroad solely by
advance payment.
2) Shipping rates for European countries
(Portugal, France, Italy, Belgium, Spain, Holland, U.K., Denmark,
Finland, Sweden, Austria, Greece) are € 8,60. Free shipping
with orders over €50.
3) Shipping rates to the USA or
Canada are €18, Free shipping over € 100.
4) Shipping
rate to other countries is €24, free over €190.
§
10 Liability
Liability of the Shop is generally
limited to damage caused by deliberate and negligent handling or a
violation of an essential element of the contractual
relationship.
§11 Data protection
Data
processing is made in accordance with the Federal Data Protection
Law. All data received from the customer are only taken, processed
and used as far as they are needed to carry out the contract
between provider and customer.
